Terms and Conditions

1. Acceptance of Terms: By renting any product (“Rental Product”) from Chemo Cold Caps Canada website (“www.chemocoldcapscanada.com”), you agree to abide by the terms and conditions outlined herein. These terms constitute a legally binding contract between you (“Renter”) and Chemo Cold Caps Canada. 

1. Rental Agreement: The rental agreement is formed when Renter places an order for a Rental Product through the Website and is confirmed by Chemo Cold Caps Canada. The agreement includes the rental period, rental fees, and any additional terms specified in the order confirmation.
2. Rental Period: The rental period begins on the date specified in the order confirmation and ends on the return date specified therein. Any extension of the rental period must be requested in advance and is subject to availability and additional fees.
3. Rental Fees and Payments: Rental fees are due at the time of booking and must be paid in full before the Rental Product is shipped or made available for pickup. Payment methods accepted include credit/debit cards, electronic funds transfer, or other methods specified on the Website.
4. Security Deposit: A security deposit is required at the time of booking to cover any potential damages or late fees. The security deposit will be refunded to Renter upon the satisfactory return of the Rental Product in accordance with these terms and conditions.
5. Shipping: Rental Products may be shipped to Renter’s designated address or made available for pickup at a designated location. Renter is responsible for all shipping costs unless otherwise specified including the return the Chemo Cold Cap Canada System at the end of the rental period.
6. Condition of Rental Product: Renter agrees to inspect the Rental Product upon receipt and notify Chemo Cold Caps Canada  of any damages or defects immediately. Renter is responsible for returning the Rental Product in the same condition as received, normal wear and tear accepted.
7. Proper Use: Renter agrees to use the Rental Product only for its intended purpose and in accordance with any provided instructions or guidelines. Misuse, abuse, or unauthorized alterations to the Rental Product are strictly prohibited.
8. Liability and Insurance: Renter assumes all risk of loss or damage to the Rental Product during the rental period. Renter is responsible for obtaining adequate insurance coverage to protect against any loss or damage to the Rental Product.
9. Indemnification: Renter agrees to indemnify and hold harmless Chemo Cold Caps Canada from any claims, liabilities, damages, or expenses arising from Renter’s use or misuse of the Rental Product.
10. Termination of Rental Agreement: Chemo Cold Caps Canada reserves the right to terminate the rental agreement at any time for violation of these terms and conditions or for any other reason deemed necessary. In such cases, Renter agrees to immediately return the Rental Product to Chemo Cold Caps Canada.
11. Governing Law: This agreement shall be governed by the laws of the province of British Columbia, Canada.
12. Modification of Terms: Chemo Cold Caps Canada reserves the right to modify these terms and conditions at any time without prior notice. Any changes will be effective immediately upon posting on the Website. It is the responsibility of the Renter to review these terms periodically for updates.
13. Severability: If any provision of these terms and conditions is found to be unenforceable or invalid, such provision shall be severed from the agreement, and the remainder of the terms shall remain in full force and effect.
14. Entire Agreement: These terms and conditions constitute the entire agreement between the parties concerning the rental of the Rental Product and supersede all prior agreements and understandings, whether written or oral.
